Terms of Service

These Terms of Service ("Terms") govern your use of this website and your booking of accommodations from Mountain Oasis Cabin Rentals ("we", "us", "our"). By accessing this site or making a reservation, you agree to these Terms.

1. Reservations and Bookings

A reservation is confirmed only after you complete the booking flow and we (or our payment processor) successfully charge the required amount. We may decline or cancel a reservation at our discretion, including for suspected fraud, misrepresentation, violation of these Terms, or unavailability of the property. Confirmed reservations are subject to the cancellation policy disclosed at the time of booking.

2. Payment, Fees, and Taxes

You agree to pay the total amount disclosed at checkout, including nightly rates, fees, deposits, and applicable taxes. Charges are processed by our payment provider; by providing payment information, you authorize us to charge the amount due. We may place a hold or pre-authorization on your payment method to cover incidentals or damage.

3. Cancellations and Refunds

The cancellation policy that applies to your reservation is the one shown at checkout and on your booking confirmation. Refunds, if any, are issued under that policy and may take several business days to appear on your statement, depending on your payment provider.

4. Guest Conduct and House Rules

By staying at one of our properties, you agree to:

  • Use the property solely for short-term lodging by the registered guests.
  • Comply with house rules, occupancy limits, and any community or HOA regulations.
  • Respect quiet hours and neighbors; no parties or events without prior written approval.
  • Refrain from illegal activity, smoking where prohibited, and any conduct that damages the property or disturbs others.

We may terminate a stay without refund and pursue costs and damages if these rules are violated.

5. Damage, Loss, and Liability

You are responsible for damage to the property or its contents caused during your stay, beyond ordinary wear and tear. We may charge your payment method for repair or replacement costs. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, and our total liability for any claim arising out of or relating to your stay or use of this site is limited to the amount you paid for the reservation in question.

6. Assumption of Risk

Use of pools, hot tubs, kitchens, outdoor areas, equipment, and surrounding amenities is at your own risk. You are responsible for the safety and supervision of any minors or guests in your party.

7. Intellectual Property

All content on this site — including text, images, logos, and design — is owned by or licensed to Mountain Oasis Cabin Rentals or our service providers and is protected by intellectual property laws. You may not copy, modify, or redistribute it without our written permission.

8. Privacy

Our handling of personal information is described in our Privacy Policy. By using this site or making a booking, you acknowledge that policy.

9. Changes to These Terms

We may update these Terms from time to time. Material changes will take effect when posted; continued use of the site after that point constitutes acceptance of the updated Terms.

These Terms & Conditions (the “Agreement”) govern your reservation for a vacation cabin from Mountain Oasis Cabin Rentals, Inc. (“Mountain Oasis,” “MOCR,” “we,” “us,” or “our”). They are a legally binding agreement between you (the reservation holder, on behalf of yourself and every member of your party — collectively, “Guests”) and Mountain Oasis. By submitting a reservation, paying a deposit, or checking into one of our cabins, you confirm that you have read, understood, and agreed to be bound by this Agreement.  

This Agreement should be read together with our Privacy Policy, which explains how we collect, use, and share personal information (including phone numbers used for text messaging and guest list information shared with gated communities). 

1. Reservation Requirements 

Age Requirement 

The reservation holder and every guest at the property must be at least 25 years of age, except for individuals under 25 who are accompanied by their parent(s) or legal guardian(s). By submitting your reservation, you confirm that you are 25 or older and that every member of your party is either (a) 25 or older or (b) under 25 and traveling with their parent or legal guardian. 

Driver’s License Required for All Reservation Holders 

All reservation holders are required to submit a copy of a valid driver’s license. The license submitted must match the name on the credit or debit card used to make the reservation. 

Driver license information is collected and stored through our reservation system, StreamlineVRS, Airbnb, Vrbo, Breezeway, or other service providers connected to your booking. We use it to verify your identity, deter fraud, confirm the age requirement above, and comply with applicable law. We do not share driver’s license images with cabin owners, gated communities, or other guests. See the Privacy Policy for full details on how this information is handled. 

Guest List Required for All Reservations 

All reservation holders are required to provide a guest list of every member of their party over the age of two. For properties located inside a gated community that requires gate access, the guest list provided to the community contains only the first and last names of party members who are 16 years of age or older, i.e., anyone who may drive into the community. Names of guests under 16 are not shared with gated communities. 

Guest list information is shared only with the gated community’s gate-access operator and only for the purpose of granting your party access during your stay. Guest list names are not added to any marketing or contact list and are not used for any other purpose. See the Privacy Policy for additional details. 

Coosawattee River Resort Bookings 

If you are staying at a property inside Coosawattee River Resort, your guest list must be submitted no later than seven (7) days prior to check-in. Additional fees may apply if the guest list is submitted later than seven days before arrival. An exception applies to last-minute reservations made within seven days of arrival; in that case, the guest list is due at the time of booking. 

Last-Minute and After-Hours Reservations 

For any reservation made within 14 days of arrival, the reservation holder must register in person at our office with a valid driver’s license and the credit card used to make the booking. There will be no same-day check-ins for reservations made after 5:00 PM. 

Office Hours and Emergency Contact 

Phones are answered by our local office Monday through Friday between 9:00 AM and 5:00 PM. After hours and on weekends, calls are answered by our after-hours team, who can answer general questions or reach our staff in an emergency. Early check-in or late check-out requests must be made at least 24 hours in advance. For true emergencies, dial 911. 

Authorization to Charge Credit Card 

By providing your credit card information, you authorize Mountain Oasis Cabin Rentals to charge that card for the rental amount agreed upon, including required fees and applicable lodging taxes. You further acknowledge that any damages not reported during your stay but discovered upon departure may be charged to the card on file. 

2. Privacy Policy Acknowledgment 

By submitting a reservation, you acknowledge that you have read and understood our Privacy Policy, which describes the personal information we collect (including identifiers, booking details, payment information, driver’s license, guest list, and communications), how we use it, and with whom we share it. The Privacy Policy is available at:

In the event of any conflict between this Agreement and the Privacy Policy regarding the handling of personal information, the Privacy Policy controls. 

3. Text Message (SMS) Communications 

When you book a stay with us, our reservation system, StreamlineVRS, collects the phone number you provide. We use that phone number to send you text messages relating to your reservation and stay. Text messages are delivered through our field operations platform, Breezeway, which receives your contact information from StreamlineVRS for this purpose. Texts may be sent using automated technology. 

Our text messages fall into three categories: 

  • Transactional messages: booking confirmations, check-in instructions, gate or door codes, and similar information directly related to your reservation. 

  • Service and operational messages: maintenance updates, weather alerts, cleaning schedule notes, and other information about your stay or the property. 

  • Marketing and promotional messages: specials, last-minute deals, holiday promotions, and re-booking offers. 

Consent 

By providing your phone number when making a reservation, you consent to receive transactional and service text messages from Mountain Oasis Cabin Rentals at that number. These messages are necessary to administer your reservation and stay. 

Marketing and promotional text messages are sent only to guests who have separately opted in by checking the dedicated marketing-SMS consent box during checkout. Consent to receive marketing text messages is not required to book a cabin, and your decision will not affect your booking or the price you pay. 

Message frequency varies based on your reservation and our communications with you. Message and data rates may apply, depending on your mobile carrier and plan. 

Opting Out 

You can opt out of marketing text messages at any time by replying STOP to any marketing message you receive from us. After you reply STOP, we will send one confirmation message and will not send you further marketing texts. We may still send transactional and service messages necessary to administer your active reservation (for example, your check-in code or an urgent maintenance alert during your stay) where doing so is permitted by law.  

We do not share your phone number with third parties for their own marketing purposes. 

4. Cancellations, Rescheduling & Changes 

Cancellations, rescheduling, or changes must be submitted in writing and confirmed by Mountain Oasis Cabin Rentals no later than twenty-one (21) days prior to the check-in date in order to receive a refund, less a $100 cancellation fee plus any applicable fees. 

If a cancellation, rescheduling, or change is made fewer than 21 days prior to check-in, no refunds will be given. However, Mountain Oasis will work with you to re-book the cabin and, if it is re-booked, a partial credit may be issued for a future booking. 

Reservations made through a third-party site (such as VRBO, HomeAway, Airbnb, or Expedia) remain subject to this Agreement. If you cancel through a third-party site and that site charges Mountain Oasis a cancellation fee, you will be responsible for that fee. The cancellation policy in effect on the third-party site at the time of booking will also apply to your reservation. 

Mountain Oasis Cabin Rentals is not responsible if you are unable to arrive, choose to depart early, or any member of your party does not show up. No refunds or rebates will be offered.  Mountain Oasis reserves the right to cancel any reservation for non-payment of the final balance within the allotted time (unless prior arrangements have been made) or for any chargebacks to the card used to secure the reservation. No refunds will be made in those cases. 

5. Required Fees 

Required fees are automatically added to each reservation. The specific required fees and their amounts may vary depending on the property. Required fees may be non-refundable. Required fees typically include: 

  • Housekeeping fee — cleaning, linen service, and amenities provided for your stay. 

  • Processing fee — covers booking administration. 

  • Home Guardian Plus Silver Protection fee — see Section 6. 

  • Resort or gate access fees — for properties inside Coosawattee River Resort or other gated communities, a resort fee covering gate access and available amenities during your stay. 

6. Home Guardian Plus Silver Protection 

A Home Guardian Plus Silver Protection fee of $69 per booking (for stays up to 29 days) is included with every reservation. Home Guardian Plus is an insurance-backed property protection program administered by a third-party provider. It may provide coverage for certain accidental, unintentional, guest-related damages discovered during a covered stay, subject to the policy’s terms, conditions, exclusions, deductibles, and claim requirements. 

The Home Guardian Plus fee is not a security deposit, is not refundable, and does not apply to the housekeeping fee. It does not release guests from responsibility for: 

  • Intentional damage 

  • Damage caused by guest negligence 

  • Violations of any policy in this Agreement (including pet, smoking, occupancy, and conduct policies) 

  • Excessive cleaning required because the cabin was not left in reasonable condition 

  • Missing items, fines, fees, or damages not covered by the program 

Guests agree to contact Mountain Oasis Cabin Rentals immediately if any damages, defects, or maintenance concerns are noticed during their stay. Damage that is not reported during the stay may not qualify for coverage and may be charged to the credit card on file. 

7. Housekeeping 

Housekeeping fees include cleaning, linen service, and amenities provided for your stay. Properties are cleaned and inspected prior to your arrival. Guests are asked to follow check-in and check-out procedures located in the cabin book and to leave the premises in a clean, undamaged condition. If a property is left in a condition that requires cleaning beyond the standard scope (for example, carpet cleaning or food left in pots and pans), an additional cleaning fee may be charged. The guest will be notified before any such charge is made. 

8. Refunds 

This Agreement is legally binding. Your reservation binds you to a specific period of time. Mountain Oasis will make every reasonable effort to correct any problem that arises during your stay in a timely manner. There should be no expectation of a refund, and no refund or relocation will be offered because you are disappointed with the property you chose to rent or because something at the property is not working to your satisfaction. No refunds or compensation will be offered for: 

  • Acts of God or nature (for example, snow, ice, severe storms, wildfires, flooding) 

  • Acts of war or actions of government agencies 

  • Road maintenance or road conditions 

  • Gas shortages, power outages, or water outages 

  • Internet, cable, or streaming-service interruptions 

Travel insurance through RentalGuardian/InsureStays is made available at the time of booking; see Section 9. 

9. Travel Insurance 

Mountain Oasis Cabin Rentals strongly recommends that guests consider purchasing travel protection through RentalGuardian/InsureStays to help protect their vacation investment. Trip insurance is available for as low as 7.5% of the booking total and may be added within 14 days after making your initial trip payment. 

Travel protection may provide coverage for certain covered events such as illness, injury, trip interruption, weather-related issues, and other qualifying circumstances, subject to the specific policy terms, conditions, exclusions, and eligibility requirements. 

Travel protection is optional and can be added at the time of booking or purchased separately by the guest. Mountain Oasis Cabin Rentals does not determine coverage, approve claims, or issue insurance reimbursements. All policy questions and claims must be handled directly through RentalGuardian/InsureStays. Declining travel protection does not alter the cancellation policy agreed to at the time of booking.

10. Check-In & Check-Out 

Check-in time is 4:00 PM; check-out time is 10:00 AM. Early check-ins/Late check-outs can be available upon request in writing 24 hours prior to check-in/check-out. If the schedule permits, we can offer up to 2 hours earlier/later than the normal check-in/check-out time, free of charge. Guests authorize Mountain Oasis to charge the credit card on file up to one night’s rental for any check-in earlier than 4:00 PM or check-out later than 10:00 AM that has not been arranged in advance. 

No check-ins are allowed on Thanksgiving Day, or Christmas Day, if another guest is checking out that day, because the cabin would otherwise need to be cleaned on a holiday. These three days are reserved for our employees to spend with their families. 

11. Directions 

Directions will be emailed seven (7) days prior to your arrival, provided that the reservation has been paid in full, the guest list has been submitted, and a copy of the reservation holder’s driver’s license has been received. To avoid getting lost, we strongly recommend that you do not rely on GPS or internet mapping once you arrive in Ellijay. Please print directions before you travel, as cell service is not always available. Mileage markers and landmarks are included to help you arrive safely. If you leave home without directions, Mountain Oasis Cabin Rentals cannot be held responsible if you are unable to find your rental unit. 

Roads leading to some rental properties are dirt, gravel, bumpy, and mountainous. Mountain Oasis Cabin Rentals is not responsible for the condition of these roads. No refunds will be offered. 

Package & Food Delivery (Amazon, DoorDash and similar services) 

We know it’s convenient to have packages or food delivered during your stay, whether that’s Amazon orders or local services such as DoorDash, Uber Eats, Grubhub, grocery delivery, and other third‑party providers. Because most of our cabins are located in gated or mountain communities, many drivers and delivery services cannot access the property directly. This can mean your order is delayed, canceled, returned, or left at a gate or central location instead of at your cabin. 

 

Mountain Oasis Cabin Rentals (MOCR) is not able to grant gate access to delivery drivers, and we cannot track, accept, store, or pick up guest deliveries. We are not responsible for any packages or food orders that are lost, stolen, delayed, misdelivered, canceled, or not delivered. Before placing an order, guests are responsible for confirming with the delivery provider whether they can access the specific community where they are staying. 

If having items delivered is important to you, please contact our office before you order. We’re happy to share what we know about the area and discuss possible alternatives, such as using a nearby pickup location or office address, so you can choose the option that works best for your stay. 

 

12. Dog Policy (Pet-Friendly Properties Only) 

Dogs only — no other pets are permitted. Up to two (2) dogs weighing 50 lbs or less are permitted at our designated dog-friendly properties. Please check the listing of your specific property to confirm whether it is dog friendly. Prior office approval is required and must be noted on your reservation if you wish to bring a dog over 50 lbs or more than two dogs. 

If a dog is brought to a property that is not designated dog-friendly without prior approval, any security deposit will be forfeited and additional charges may apply. 

Dog Rules 

  • Dogs are not permitted in any hot tub or pool. A minimum cleaning fee of no less than $200 if a dog enters either. 

  • Dogs must be completely housebroken, well-behaved, and pest-free. 

  • A dog bed may be provided at our dog-friendly cabins. Dogs are not permitted on furniture or on or in human beds. An additional fee will be applied if there is evidence of a pet on furniture. 

  • Dogs must be crated when left alone in the cabin. Locking a dog in a room is not permitted, as this is when most damage occurs. 

  • Guests are responsible for the full cost of any damage caused by their dogs. 

  • If a dog has an accident inside the cabin, all clean-ups are the guest’s responsibility. Guests must also pick up waste from the grounds and dispose of it in outside garbage cans. Failure to clean up inside or outside will result in an additional cleaning charge of no less than $50. 

  • Guests are responsible for keeping dogs under full control at all times. Dogs must be on a leash whenever they are outside, unless in a fenced enclosure. The cabins are surrounded by thousands of acres of forest, and pets can become lost easily. 

By accepting this Agreement, you authorize Mountain Oasis Cabin Rentals to charge the credit card on file for any damage caused by your pets or any violation of this Dog Policy. 

13. Conduct 

Each of our properties is privately owned and is not built to accommodate large groups. Only the guests listed on the guest list are permitted at the cabin. Our cabins are not venues for parties, reunions, or similar events where the number of people present (including non-overnight visitors) would exceed the guest list or maximum occupancy. 

Guests agree to comply with the all County Noise Ordinances. Quiet hours are 10:00 PM to 8:00 AM Sunday through Friday morning, and 11:00 PM to 8:00 AM Friday evening through Sunday morning. Noise carries in the mountains; please refrain from excessive noise between 10:00 PM and 8:00 AM. 

Guests agree not to trespass on neighboring properties. Vehicles may only be parked in designated areas; do not park on roadways, streets, or yards. Vehicles parked improperly may be towed at the owner’s expense, and improperly parked guests may be in violation of the County Short Term Rental Ordinances. 

Use of the premises must not disturb or offend neighbors or residents. Prohibited activities include but are not limited to parties; excessive speeding through neighborhoods; riding ATVs, off-road motorcycles, or dirt bikes; excessive noise; obnoxious behavior; discharging firearms, BB/pellet guns, paint ball guns, or fireworks; and similar disruptive conduct. 

If maximum occupancy is exceeded, guests will be charged a minimum of $200, and the violation may result in immediate eviction with no refund. Mountain Oasis Cabin Rentals reserves the right to terminate this Agreement and require disruptive guests to vacate the premises, thereby forfeiting all monies paid. No refunds or rebates will be offered in connection with any conduct violation. 

14. No Smoking 

All cabins are non-smoking properties. This includes vaping, incense, and anything else that emits smoke or odor. If you are unsure whether something qualifies, please call the office for clarification. Guests agree to pay no less than $250 for odor abatement if they smoke in the cabin or if cigarette butts are left on the grounds. 

15. Alcohol & Drug Policy 

No drinking of alcoholic beverages by persons under the legal age of 21 is allowed at any rental property. If a guest is arrested for underage drinking at a rental property, or if Mountain Oasis observes a guest under 21 drinking alcoholic beverages on the premises, this Agreement may be terminated and guests evicted with no refund or rebate. Illegal drug use is strictly prohibited. 

16. Occupancy 

Maximum occupancy is stated in each property’s listing description. Each additional guest over the age of 2, including non-overnight visitors, must be listed on the guest list and on file with Mountain Oasis Cabin Rentals. Roll-away beds, inflatable mattresses, and sleeping bags are prohibited unless approved in advance of arrival. 

17. Amenities 

Cable / Satellite TV / Streaming 

Mountain Oasis Cabin Rentals cannot guarantee TV channel availability. Some rental properties offer premium packages (movie channels, sports channels, etc.); most properties now provide smart TVs for streaming. Neither Mountain Oasis nor guests may activate premium channels. If guests unplug equipment and it is not reconfigured correctly, resulting in a reconnection service call, the guest will be charged no less than $75.00. 

Furnishings / Furniture 

All furnishings and furniture in the cabin are arranged as the owner has placed them. Guests agree to pay no less than $100 if furniture is rearranged in a way that delays cleaning services. Furniture and furnishings may be replaced periodically; as a result, photos on the website may not be an exact replica of what is currently in the cabin. 

Land lines and Cell Service 

Cabin telephones are toll-restricted and do not permit long-distance calls. Guests agree that any special feature calls (including, without limitation, Call Return, Call Block, and Call Forward) they activate will be billed to the credit card on file plus a $15 service charge per incidence.  

Cell phone coverage varies by carrier and may be poor or non-existent in some areas. 

Propane Grills 

Properties with propane grills are fueled by liquid propane. Under no circumstances may guests add charcoal or any derivative of charcoal to a propane grill. If charcoal is added to a propane grill, Mountain Oasis Cabin Rentals is authorized to charge no less than $100 to the guest’s credit card for grill cleaning. 

Fireplaces & Fire Pits 

Fireplace season is October 1 through April 15; fire pits may be used year-round. DO NOT LEAVE BURNING OR SMOLDERING FIRES UNATTENDED. 

Both gas log and wood-burning fireplaces are seasonal and are only operational from October 1 through April 15, with exceptions authorized if unpredictable cold weather requires it. 

Gas log fireplaces: no other items may be burned in a gas log fireplace, including but not limited to sticks, wood, charcoal, or lava rocks. Gas logs may not be moved or re-stacked; guests agree to pay no less than $250 if logs have been moved or damaged. 

Wood-burning fireplaces: only the 4 to 6 hour fire logs (such as Duraflame) may be used in any wood-burning fireplace. This rule exists for guest safety and owner protection, due to multiple past incidents of damage caused by overloaded fireplaces. One fire log will be supplied for each wood-burning fireplace, and only one log should be used at a time. If a wood-burning fireplace has a gas line, the gas key may not be used; the line has been capped off, and no gas is available. Guests agree to pay no less than $250 if anything other than the approved fire log is used in a wood-burning fireplace, without prior written consent. 

Fire pits: Firewood is not provided for use in fire pits. Guests must provide their own wood. If a property does not offer a fire pit, guests may not create one. If one is found, guests agree to pay no less than $250 plus any fines associated. Guest agrees to follow all burn bans or restrictions, implemented by local authorities and communities. Guests will be responsible for any fines and fees for breaking any burn bans or restrictions. Burn Bans/Restrictions are posted near community gates and can be confirmed by MOCR office.   

Hot Tubs & Pools 

Guests may not add any objects, soaps, or chemicals to hot tubs or pools. Guests agree to pay no less than $100 if a hot tub or pool is compromised in a manner that delays cleaning services. Hot tubs and pools are cleaned prior to guest arrival. Guests agree to pay an additional charge if they request an additional cleaning of a hot tub during their stay. 

Hot tub and pool usage are at the guest’s own risk. Guests agree not to hold Mountain Oasis Cabin Rentals or the property owner responsible for any injury or reaction from use of the hot tub or pool. Children may not be in a hot tub or pool without a responsible adult. Dogs are not permitted in pools or hot tubs; if there is evidence that a dog has been in either, a charge of no less than $200 will apply. Pool/hot tub rules are posted at the property, and guests agree to follow them. 

18. Internet Access 

As part of this rental package, Mountain Oasis Cabin Rentals and the cabin owner/account holder offer access to internet service through an account with ETC. By accepting this Agreement, the reservation holder agrees to abide by ETC’s Acceptable Use Policy and Terms of Service (viewable at etcnow.com under “Terms and Conditions”) and to the additional terms set forth below. 

Changes to the system may be made by ETC during your use. Mountain Oasis Cabin Rentals and the property owner/account holder are not responsible for degraded or interrupted internet service. All information received from or through the account is provided on an “as is, as available” basis, and all warranties, express or implied, are disclaimed. If you are dissatisfied with the internet access, you may immediately discontinue use; that is your sole remedy. Access would not be made available without these limitations. 

Access is furnished on the condition that it will not be used for any unlawful purpose. You certify that you are 25 years of age or older, that any minor’s use of the service during your rental period is deemed to be with your express permission, and that you, as the reservation holder, are solely responsible for the actions of any minor in using this account. Permission to use any passwords or access codes terminates upon termination of your rental contract. 

You agree to defend, indemnify, and hold Mountain Oasis Cabin Rentals, Inc., and the property owner/account holder harmless from any and all liabilities, costs, and expenses (including reasonable attorneys’ fees) related to or arising from any violation of this Agreement by you or those who access the service and account through you, and the use of the internet and the placement or transmission of any message, information, software, or other materials on the internet by you or those who access the service through you. 

19. Maintenance Issues 

In the event of a breakdown of any property equipment, guests must notify Mountain Oasis Cabin Rentals immediately. We will make every reasonable effort to correct any problem in a timely manner. We cannot guarantee heat, air conditioning, electricity, water, appliances, cable, satellite, television, telephones, electronics, gas logs, grills, or similar items. No refunds or rebates will be issued for such issues. If a repair person is dispatched and the equipment is found to be in working order or the problem is due to guest oversight, neglect, or misuse, the cost of the service call may be billed to the credit card on file. 

20. Lock Out 

A lock-out from your cabin will result in a $75 service call during business hours. After business hours, a lock-out will result in a $125 fee to send someone from our company, or a locksmith may be called, and the credit card on file will be charged accordingly. 

21. Key Return & Amenity Passes 

Guests are responsible for returning the property key. Keys are to be returned to the lock box or as instructed in the cabin. If the property key is not returned at check-out, Mountain Oasis is authorized to charge the credit card on file no less than $100 to cover the cost of re-keying or replacing the locks and reissuing keys to owners, cleaning crews, and Mountain Oasis Cabin Rentals. 

Amenity cards are available at certain properties for guest use. There will be amenity passes hanging in the cabin if applicable. Please be aware there is a charge of $85.00 to replace each card if missing after your departure.  

22. Wildlife, Insects & the Natural Environment 

Our properties are in the mountains and woods. Depending on the time of year, you may encounter bears, deer, turkeys, ladybugs, carpenter bees, wasps, scorpions, snakes, ticks, ants, chiggers, squirrels, mice, rats, or other wildlife, pests, or insects. We encourage you to dress accordingly and to bring insect repellent for outdoor activities. No refunds will be given because you encounter wildlife or insects, whether inside or outside the property. 

23. Construction & Routine Maintenance 

Construction of new accommodations and attractions occurs from time to time in the area. No refunds or rebates will be offered for inconveniences caused by construction, construction noise, road repair, or road maintenance. Routine property maintenance (grass cutting, weed eating, leaf blowing) may take place during your stay; when it does, it will not begin before 9:00 AM, and every reasonable effort will be made not to disturb you. Lawn services will not be rescheduled simply because a guest prefers not to hear a lawn mower, weed eater, or leaf blower. 

24. Right of Entry 

Guests acknowledge and agree that Mountain Oasis Cabin Rentals reserves the right to enter the property at any time to investigate disturbances, verify occupancy, inspect for damage, make repairs, and make alterations or improvements. 

25. Items Left at the Cabin 

Mountain Oasis Cabin Rentals is not responsible for any items guests leave behind in a cabin. If items are found, we will make a reasonable effort to contact the guest about returning them. A fee of $50 plus shipping costs will be charged to the credit card on file for the return of any item. Items will be discarded or donated after 7 days unless a different arrangement is confirmed by Mountain Oasis in writing (email). 

26. Damages to Property 

Premises must be left in a clean, undamaged condition. Guests must follow the check-in and check-out procedures located in the cabin book or in the kitchen, as well as the Dog policy if applicable. Properties are cleaned and inspected prior to your arrival. Guests agree to notify Mountain Oasis Cabin Rentals immediately if any damages or defects are noticed. If the property is left in a condition that requires cleaning beyond the standard scope (for example, carpet cleaning or food left in pots and pans), an additional cleaning fee may be charged. The guest will be notified before any such charge is made. See Section 6 for information about the Home Guardian Plus Protection Program. 

27. Agency Disclosure 

Mountain Oasis Cabin Rentals serves as the agent for and represents the owners of vacation properties in its rental program, and acts at all times in the best interest of those owners. Guests are licensees of the property owner, not tenants, and do not acquire any interest in the property. 

Mountain Oasis strives to honor every reservation request for a specific property. However, due to ownership changes, properties being removed from the rental program, mechanical issues, or other unforeseen circumstances, Mountain Oasis cannot absolutely guarantee a specific property. Mountain Oasis reserves the right to change the property assignment without liability if the rental property becomes unavailable. Where comparable properties are not available, guests will have the option of selecting from available properties at the published rate or receiving a complete refund. 

Mountain Oasis Cabin Rentals reserves the right to refuse service to anyone. All rental properties are leased without regard to race, color, religion, sex, national origin, disability, familial status, or any other classification protected by applicable law. Information regarding individual listings is believed to be accurate but is not guaranteed. 

28. Violation of Terms & Conditions; Expedited Eviction 

Mountain Oasis Cabin Rentals reserves the right to remove any guest who fails to comply with this Agreement. No refund or rebate will be offered in such cases. 

A material breach of this Agreement by guests which, in the sole determination of Mountain Oasis, results in damage to the premises, personal injury to guests or others, a breach of the peace, a nuisance to others, or a violation of criminal law or local code shall be grounds for termination of guests’ occupancy. Violation of any of the rules contained in this Agreement may result in immediate eviction and forfeiture of all rent and any security deposit. 

To the extent permitted by Georgia law, the expedited eviction procedures available under Georgia statute may be used. Guests may be evicted under such procedures if they: 

  • Hold over in possession after their occupancy has expired; 

  • Commit a material breach of any provision of this Agreement that, by its terms, would result in termination of the occupancy; 

  • Fail to pay amounts due as required by this Agreement; or 

  • Obtained possession of the premises by fraud or misrepresentation. Any reservation made under false pretenses will result in forfeiture of advance payments, and the party will not be permitted to check in. 

29. Governing Law & Venue 

This Agreement shall be governed by and interpreted in accordance with the laws of the State of Georgia and shall be treated as though it were executed in Gilmer County, Georgia. Any action relating to this Agreement shall be instituted and prosecuted only in the Gilmer County Superior Court, Ellijay, Georgia. Guests specifically consent to such jurisdiction and to extraterritorial service of process. 

30. Indemnification & Hold Harmless 

Guests acknowledge and agree that they are solely responsible for any property damage, accident, or injury to any person, or any loss sustained by any person (including loss of money, jewelry, or other personal property), arising out of or in any way related to their use of the premises or the personal property provided by Mountain Oasis Cabin Rentals or the property owner at the guest’s request. Guests shall inspect and be familiar with the proper use of such items prior to using them. 

Guests agree to INDEMNIFY and hold Mountain Oasis Cabin Rentals, its employees, owners, and officers, and the property owner harmless from any and all claims, including those of third parties, arising out of or in any way related to the guests’ use of the premises or the items of personal property provided therein. Guests further agree to hold Mountain Oasis Cabin Rentals and/or the property owner, employees, and officers harmless from and to indemnify them against any and all claims arising during or after the course of the rental as a consequence of any acts or omissions of Mountain Oasis Cabin Rentals and/or the cabin owner, employees, and officers. Guests assume the risk of injury or other losses related to any recreational activities and will hold the owner and Mountain Oasis Cabin Rentals harmless with respect thereto. 

31. Force Majeure 

Neither party will be in breach of this Agreement, nor liable for any failure or delay in performance, to the extent such failure or delay is caused by events beyond that party’s reasonable control, including acts of God, severe weather, natural disasters, wildfires, floods, ice storms, epidemics or pandemics, government orders or actions, acts of war or terrorism, civil unrest, utility or telecommunications failures, road closures, or fuel shortages. The cancellation and refund terms in Section 4 will continue to apply during any such event. 

32. Electronic Signature & Acceptance 

By submitting a reservation, paying a deposit, or checking the “I agree to the Terms & Conditions” box during checkout, you accept and electronically sign this Agreement. You agree that this Agreement may be entered into and accepted electronically, and that an electronic acceptance has the same legal force and effect as a handwritten signature, as permitted by the Uniform Electronic Transactions Act and similar laws. 

33. Entire Agreement, Severability & Modifications 

This Agreement, together with our Privacy Policy and any property-specific information provided to you (such as your reservation confirmation and check-in materials), constitutes the entire agreement between you and Mountain Oasis Cabin Rentals regarding your stay and supersedes any prior agreements or understandings. If any provision of this Agreement is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. 

We may update this Agreement from time to time. Material changes will be reflected by an updated “Effective Date” at the top of this document and, where appropriate, additional notice (such as an email to guests with active reservations). The version of this Agreement in effect when you make your reservation will govern that reservation.
